Estate Planning

At Kasper and Associates we understand that the process of creating an estate plan can sometimes be a daunting one. Therefore we strive to provide a positive, informative and affordable experience to each of our estate planning clients. While having an up to date set of estate planning documents is important, it is our firm’s belief that providing clients with the tools to understand and control their estate plan is equally important to create a dynamic, individualized estate plan that best addresses the client's unique needs. Guardianship

Expect us to act as your advocate in the guardianship proceeding. A legal representative for the proposed ward will be appointed by the court. Because of this fact, family members seeking to establish a guardianship need the advice and assistance of an attorney.

A guardianship will be granted only if the person petitioning for guardianship can prove beyond a reasonable doubt that the proposed ward is unable to provide for his/her basic needs, such as food, shelter, clothing, healthcare, safety, and/or the proposed ward is unable to manage his/her financial affairs.

The petitioner must be able to prove in court that the proposed ward is incapable of making an informed choice regarding his/her basic needs, and must also prove that the proposed ward will or has sustained substantial harm as a result of his/her incapacity. Finally, the petitioner must be able to prove that there are no other available solutions that would impose fewer restrictions on the proposed ward.

Anyone seeking to establish a guardianship must present evidence to the court showing beyond a reasonable doubt that a guardianship is needed. The petitioner will need to present witnesses including a medical professional and familyor friends who have observed the proposed ward and can support the petitioner's claims of incapacity.

Our office has successfully represented both petitioners and proposed wards in New Hampshire and Vermont. If you or a loved one requires representation in a guardianship or conservatorship proceeding, Kasper and Associates can assist you by providing the following services:

  • Legal representation in the Proceedings
  • Preparation of filings, including the Petition, affidavits of witnesses and waivers of appearance
  • Preparation and presentation of witnesses and evidence at the hearing
