Expect us to act as your advocate in the guardianship proceeding. A legal representative for the proposed ward will be appointed by the court. Because of this fact, family members seeking to establish a guardianship need the advice and assistance of an attorney.

A guardianship will be granted only if the person petitioning for guardianship can prove beyond a reasonable doubt that the proposed ward is unable to provide for his/her basic needs, such as food, shelter, clothing, healthcare, safety, and/or the proposed ward is unable to manage his/her financial affairs.

The petitioner must be able to prove in court that the proposed ward is incapable of making an informed choice regarding his/her basic needs, and must also prove that the proposed ward will or has sustained substantial harm as a result of his/her incapacity. Finally, the petitioner must be able to prove that there are no other available solutions that would impose fewer restrictions on the proposed ward.

Anyone seeking to establish a guardianship must present evidence to the court showing beyond a reasonable doubt that a guardianship is needed. The petitioner will need to present witnesses including a medical professional and familyor friends who have observed the proposed ward and can support the petitioner's claims of incapacity.
